Terms and Conditions

Last updated: September 14, 2026

These terms apply whenever you use dianascuisine.com or place an order with Diana’s Cuisine. By placing an order, you agree to them. They describe the service as it actually works, not a generic restaurant template. Diana’s Cuisine is a home-based Nigerian food business serving Scarborough and the Greater Toronto Area by pickup and delivery only. There is no public storefront or dine-in service.

1. How ordering works

You can place an order for the regular menu at any time. At checkout, you choose a pickup or delivery date from the days we currently have open (the available dates are shown at checkout and can change); other days can sometimes be arranged directly with us, but are never guaranteed by default. The Weekend Special, when Diana is running one, is a separate, time-limited feature with its own ordering countdown (see section 5).

2. Order acceptance

Submitting an order and paying is a request to purchase, not an automatic guarantee: an order is accepted once you receive an order number, a verification PIN, and a confirmation email. Every price is recalculated on our server from the current menu at the moment you order; a price shown while you were browsing earlier isn’t locked in until checkout.

3. Pricing and tax

All prices are listed in Canadian dollars. Menu prices, sizes and add-on pricing can change from week to week as Diana finalizes the menu. Ontario HST is included in the data model and will appear as a separate line once it is switched on; until then, it is charged at 0%.

Where a dish is marked with a percentage-off sale, the discounted price shown at the time you add it to your cart is the price you pay; sales can be changed or removed at any time and don’t apply retroactively to orders already placed.

4. Payment

Payment is processed securely by Stripe (card, Apple Pay, Google Pay). We do not see or store your full card details. If new orders are temporarily paused when you check out, your order is instead handled as a late request (see section 6), with payment collected only if Diana can fit it in.

5. The Weekend Special

The Weekend Special is a curated, time-limited selection of dishes Diana features for a limited time, in limited quantities. It is ordered the same way as anything else on the menu and is part of the same order and checkout, not a separate purchase with different terms. Once the current Weekend Special closes or sells out, it is unavailable until the next one is published; the rest of the menu is unaffected.

6. Availability, sold-out items, and late orders

Menu items can sell out or be marked unavailable, including after you’ve started browsing. If an item in your order becomes unavailable before your order is confirmed, checkout will reflect that rather than silently substituting something else. If new orders are temporarily paused when you order, it is treated as a late order request: you are not charged unless and until Diana confirms she can fit it in and sends a secure payment link. The Weekend Special also has its own ordering deadline, shown with a countdown on the site; missing it does not affect the rest of the menu.

7. Cancellations

We prepare your food fresh to order, and often buy ingredients specifically for it ahead of time. Because of this, if you need to cancel an order, how much is refunded depends on how much notice you give us:

Depending on the circumstances, we may also offer to reschedule your order or provide credit toward a future order instead. This is at our discretion, not a guarantee.

If Diana’s Cuisine needs to cancel your order for any reason, you’ll receive a full refund.

If you miss your scheduled pickup, another pickup time or delivery may be arranged, subject to availability. Any additional delivery or related costs will be your responsibility.

8. Refunds and problems with your order

Refunds for a cancelled order follow the schedule in section 7 above. If something isn’t right with your order, whether it’s missing an item, arrived damaged, or wasn’t what you expected, please let us know within 24 hours of your pickup or delivery. Because our food is perishable, reporting a problem promptly helps us look into what happened and work with you toward a fair resolution. We review every report individually and do our best to make it right, though we can’t promise a refund for every concern.

To cancel an order, report a problem, or ask about rescheduling, text us at (416) 529-8636 or message us on Telegram.

9. Pickup and delivery

Pickup is free; delivery pricing is calculated from the distance to your address at checkout. You’re responsible for providing an accurate name, phone number and address. We are not responsible for a missed delivery or pickup caused by incorrect information you provided. If a friend, family member or courier is collecting on your behalf, they will need your order number and PIN; sharing those with a third-party pickup person is your choice and your responsibility.

Once your order has been delivered or collected, you’re responsible for storing, reheating and consuming it appropriately.

10. Allergens and dietary requests

All food is prepared in a kitchen where common allergens are present, and we cannot guarantee any dish is completely free of traces of them. See the full allergen information on the homepage. If you have an allergy, intolerance or dietary requirement, tell us before ordering; if it’s severe, contact us directly rather than relying on an order note alone. Your selected spice/pepper level and any notes you add are instructions to the kitchen, not a guarantee of an exact outcome every time.

11. Gift orders

If you send a gift, you’re responsible for providing an accurate name, phone number and address for the recipient. Diana’s Cuisine is not responsible for a failed delivery caused by incorrect recipient information, and cannot guarantee a specific delivery time beyond the agreed pickup/delivery day.

12. Website use

You may use this website to browse the menu and place genuine orders. You agree not to:

All content on this site, including the Diana’s Cuisine name, logo, photography, and written content, belongs to Diana’s Cuisine and may not be used without permission.

13. Limitation of responsibility

We take reasonable care in preparing your order and operating this website, but to the extent permitted by law, Diana’s Cuisine is not liable for indirect or consequential losses arising from use of the site or an order (for example, a missed event because of a delivery delay outside our control). Nothing in these terms limits any right you have under applicable Canadian consumer protection law that cannot be excluded.

14. Changes to these terms

We may update these terms as the business and website evolve. The “last updated” date at the top always reflects the current version. Continuing to order after a change means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
